1. Definitions

For the purposes of these Terms of Service:

Account: A unique account created for You to access our services.

Business/Company: Refers to GCM (Growth Capital Management), the entity providing the services.

Consumer/You: The individual or company accessing or using the services.

Device: Any device (e.g., computer, mobile, tablet) used to access the services.

Service: Refers to the services provided by GCM, including support for prop firm challenge passing, account management, and other trading-related services.

Terms of Service: These Terms and Conditions that govern your use of the services provided by GCM.

Promotions: Special offers, contests, or sweepstakes offered through the service.

Feedback: Suggestions or comments provided by You regarding the performance or features of our services.

2. Acknowledgment

By accessing or using our services, you agree to be bound by these Terms and Conditions. If you disagree with any part of these Terms, you may not use the service.

You acknowledge and understand that:

GCM is not a brokerage or proprietary trading firm, and we do not provide trading accounts to clients.

We do not provide financial, investment, or trading advice.

Prop firm challenge passing and account management come with significant risk and may not be suitable for all investors.

There are no guarantees of profits or successful outcomes, and past performance is not indicative of future results.

GCM is not responsible for the actions or decisions of third-party trading platforms or brokers.

3. Services Offered

GCM provides two key services:

Passing Evaluation Service: We assist clients in successfully completing proprietary trading firm challenges.

Account Maintenance Service: We manage and maintain funded accounts on behalf of clients, taking a percentage of the payout as compensation.

For the account maintenance service, GCM takes a 60/40 payout split from the profits. This percentage can change based on agreement terms.

4. Payment Terms

For the Passing Evaluation Service, payment is split into two parts:

50% upfront before the service is provided.

50% upon completion after the service is rendered.

5. User Accounts

You are responsible for maintaining accurate and current information in your account.

Accounts registered by bots or automated methods are prohibited.

You are responsible for safeguarding your account credentials and any activity that occurs under your account.

You agree not to share your login credentials with any third party.

6. Intellectual Property

All content and materials provided through the service, including the GCM platform, are owned by GCM and its licensors. These materials are protected by copyright, trademark, and other laws. You may not use, copy, or distribute any content without proper authorization.

7. Prohibited Activities

You agree not to:

Resell, redistribute, or commercially exploit our services.

Engage in any form of data scraping, reverse engineering, or malicious activity on our platform.

Use the services for illegal or unauthorized purposes.

Manipulate market data or engage in fraudulent activities.

8. Termination

We may terminate or suspend your account immediately if you breach these Terms or for any reason we deem appropriate. Upon termination, your right to use the service will cease immediately.

9. Limitation of Liability

GCM assumes no responsibility for any financial, legal, or operational damages arising from the use of our services. To the maximum extent permitted by applicable law, GCM and its affiliates are not liable for any indirect, incidental, or consequential damages, including loss of profits or data.

10. Disclaimer

The services provided by GCM are offered "AS IS" and "AS AVAILABLE." We make no representations regarding the accuracy, reliability, or availability of the service. You agree that you use the service at your own risk.

11. Governing Law

These Terms are governed by the laws of the United Kingdom, excluding its conflicts of law rules. Any disputes related to these Terms will be subject to the jurisdiction of the courts in the United Kingdom.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. Any changes will be posted on this page, and by continuing to use the service, you agree to the updated terms.

13. Legal Compliance

You are responsible for ensuring your use of the services complies with all applicable local, state, and international laws. GCM is not liable for any legal consequences resulting from misuse or non-compliance.
